In Oregon, legal custody refers only to who holds the responsibility of making big decisions for the child (such as those related to education, residence, and healthcare). When legal custody is jointly held, the parents share this decision-making responsibility. Joint legal custody must be agreed to by both parents to be awarded by the judge. Parenting time is a separate arrangement that determines how much time the child spends living with each parent. Therefore, even if one parent has sole legal custody, the child could still live with each parent 50% of the time.
